Judge H.J. Fabricius

Judge H.J. Fabricius is a retired judge whose ruling on tender cancellation procedures drew scrutiny during the commission’s proceedings. In testimony, Commissioner Spies recounted that Fabricius had interpreted the then-applicable legislation as containing only a very narrow provision under which a tender could be cancelled. According to that account, the wording of the law did not include terms such as “irregular” or “missing,” and Fabricius consequently ruled that those grounds could not be used to cancel a tender.
