Carrim / Mogotsi / Matlala loan chain + ANC event payments

The Brown Mogotsi Foundation, with Mogotsi deposing affidavits, interdicted a tender process by the North West Health Department. Funding for the legal action came from Carrim and Kareem.

Suleiman Carrim transferred R35 million to Vusimuzi Matlala on 12 December 2023. Carrim later said he believed this was in advance of a preservation order.

Suleiman Carrim made initial payments totalling millions of rand to Morgan Maumela, facilitated by Vusimuzi Matlala, as part of the Medicare 24 contract arrangement in the lead-up to the SAPS award.

Matlala arranged delivery of impalas from a Rudy Farm manager on 21 March 2024, with payment and address details exchanged via WhatsApp — illustrating the informal gift and livestock economy around the network.

Brown Mogotsi sent his first WhatsApp message to Lt-Gen Mkhwanazi on 30 September 2024, introducing himself and claiming to have information about a plot to discredit Mkhwanazi.

Mogotsi participated in a covert section 252(A) recording operation to capture conversations about a plot to remove General Khan from his position, involving senior officers. The operation was authorised.

Vusimuzi Matlala alleged that he and his wife were assaulted on 6 December 2024. Mogotsi was aware of the allegations.

Mogotsi sent a WhatsApp message to Minister Mchunu on 23 December 2024 stating "We got a breakthrough", referring to progress in the effort to arrest Lt-Gen Mkhwanazi.

Brown Mogotsi forwarded the Minister's 31 December 2024 disbandment letter for the PKTT to Vusimuzi Matlala on 2 January 2025, sharing classified information about the PKTT with a civilian contractor.

By early March 2025, Matlala became aware that the SAPS Medicare 24 contract was heading for cancellation, prompting communication with Carrim and Mogotsi. The formal cancellation followed on 13 May 2025.

Suleiman Carrim underwent an eye operation on 3 March 2025, later citing it as grounds for medical inability to attend Commission hearings.

The Commission presented geolocation data challenging Carrim's account of his movements, which bears on his claimed medical incapacity.

Mogotsi travelled to Kenya on 10–12 September 2025 to investigate allegations that Lt-Gen Mkhwanazi was a CIA operative, meeting contacts and reporting back.

Advocate Johnson alleged he and Ms Ramsamy were manipulated by Binang, potentially affecting the inquiry's proceedings.

The Commission issued rulings on procedural matters, including Carrim's postponement application, and made them available via its website and the media.

The Commission examined the management of Carrim's businesses, including the role of his PA, wife, and son, and outstanding financial statements and auditor information.

Brown Mogotsi filed an application for the recusal of Chief Evidence Leader Advocate Chaskalson on 9 March 2026, alleging improper pressure was placed on him to implicate Carrim. The application was heard and denied.

Carrim sought to postpone his testimony, citing medical incapacity. The Commission challenged his movements and medical evidence, leading to a ruling that Carrim must appear and testify on 14 August 2026.

Mr Carrim did not appear on 14 August 2026 despite a ruling that he must. Evidence leader Adv Baloyi SC placed on the record that there was no basis to treat him as properly excused, no satisfactory explanation for the non-appearance, and that the condition prescribed as the basis for excusing him had not been complied with. Counsel for Mr Carrim (Mr Premhid) put the contrary position that his client was cooperating and was not running away from accountability.

The basis on which Mr Carrim could be excused from appearing was an independent medical assessment. The Chairperson recorded that Mr Carrim was resisting being examined by an independent practitioner, had refused that it be done, and had instead offered his own specialists. Counsel for Mr Carrim described an alternative mechanism his side had proactively offered and undertook to cooperate if it were used.

The Chairperson stated that the Commission could not force Mr Carrim to appear, that this was the end of the road as far as having him before the Commission was concerned, and excused him. He also noted that Mr Carrim could take the Commission's decision on review, and that any defences to the criminal process were for Mr Carrim to raise there. A witness central to the SC0007 loan chain therefore leaves the Commission's reach without having been examined on it.
